Default Left Hand Turn w/o looking at oncoming traffic

This guy was looking for a way to get onto another road going north out of town (Seattle.) He saw the entrance to I-5 but did not want to get on to the highway. There was a residential street that paralleled the highway and he fixated on that street as he swerved into my path. I am always on the two finger thing and was on the brakes immediately. It did not matter though because he was not slowing. As I had a death grip on the bars, at impact I pivoted on the bars and did a backflip into the windshield of the car. My head was on the hood of the car and my feet on the roof. I rolled off the car and charged towards the driver of the cage. I asked him what the hell was he doing and why he did not see me. I was pissed. I decided it was not good to be so mad and took control of my emotions and asked if he was all right.
He was a nice person and we talked for a while before the police arrived.

The Aerostich with all that padding saved my skin. My wrists are very sore and I am going in today to have my Doctor take a look at them.

Watch out for those cagers!!!


The front end of the bike is no longer attached.

Tank bag tore off as I flew over the bars.

Front wheel is bent and it was a chore to haul the bike into the back of the Ride West service van.

Really glad to hear you came away not too badly off, I'm sure you'll have a few aches and pains in the morning.

Wow!!! Hate to see that. I know you're aware of how lucky you are to be pretty much OK. It could have been much worse and I'm thankful that you're OK. All the gear surely does pay off. All we can do is be as careful as we can be, looking out for the other guy and hope if it does happen we're as fortunate as you. Good luck with repairs and get back on the road soon.

The dealer is saying it is totaled. The driver was insured through GEICO. All I hear about GEICO is horror stories. Do I get anything for pain and suffering?
At least getting compensated for being without my beloved machine.

The best thing is, I did not lay it down!

Default This should be settled in two pieces

I will tell you what I know from me being rear ended this summer.
1. If driver of cage was issued a citation makes it a little easier but first and foremost Piece One is your property claim i.e. a new bike. Also a rental if this can be accommodated. This should be done immediately.
2. This piece is bodily injury claim and pain and suffering. BI is basically your expenses (medical costs) if your are insured and your insurance picks up medical costs they can subrogate (make a claim against you for any of their cost from whatever you are awarded) so make sure you keep good records. Also your pain and suffering is basically a factor equation and is somewhere between 2 to 3 times medical cost. Do not be in a hurry to settle! Piece two of this has some statute of limitations. Here in Oklahoma it is 2 yrs. You would need to find out what your states is. Remember the claims departments job is to settle this for as little as possible and they have staff attorneys that cost them very little in relationship to what it can cost you. Also when you talk to claims dept. do not let them record you they can take all the written notes they want but no recordings.

Be patient but you do not need to hire an attorney just yet.

Also I am not an attorney and I am glad you are not hurt anymore than you were

Just go see a lawyer. Most insurance companies want to stay out of court and and will settle for the full amount of the personal injury policy. This is the word from a guy whose lawyer went after his insurance because the other guy didn't have any and I got $$$. Amazingly, I even got $$$ from the policy on my auto, which is with another company.

Glad you are not badly hurt, as it could have been a lot worse.

First of all, try to find a witness or two, as they are worth their weight in gold. I would not hire an attorney just yet, as you can do that at any time. Hiring an attorney now, will cost you a third of what you settle for.

Do give the other company a recorded statement of what happened. Also, Pain and Suffering is normally three time your medical bills, lost wages and other stuff combined. Also, you can get lost wages if any and you also can get loss of Consortium, which is your inablilty to have sex with your partner due to the accident (this is a legitimate factor in your pain and suffering) . It is normally calculated by how many times a week you have sex with your partner, then calculating how much it would cost if you had to go our and buy it. For instance, if it would cost you $100.00 each time to buy it, and you have sex twice a week, and it takes you two months to recuperate, then: Then it would be, eight weeks at twice a week would come to sixteen times $100.00 it would cost you to go out and have sex. SO, Sixteen times at $100.00 per time would be a loss of $1,600.00, to add to your pain and suffering. Then, add your missed work days due to the accident, how much you make a day time the days you were out due to your accident. Add your medical bills to that, then come up with a total then they should pay you three times that amount.

But whatever you do, when you take that recording statement, tell them how much you are hurting and that you have already been to a doctor and will have to return until he releases you.
